I'm sure there are companies out there who are totally oblivious to a security hole in their software when they put it on the shelf.

I don't really agree that legal action should be pursued against such companies. If that were the case the number of companies releasing software would dramatically decrease over time due to some software houses being put out of business.

Rather than pursuing legal action, why not put your faith into someone you can trust to deliver good applications, secure applications and stick with them. Not every company has an emphasis on security or for that matter, the staff to cope with the demands of security testing.

Instead of jumping the gun and threatening legal action, choose a name you can trust, or at least have faith in to provide you with the security you need, as well as quick turnaround with advisories/patches/etc. if a security hole is found.
